With the advent of modernity, law enters an irreducible contradiction. It must, simultaneously, limit the force available to the State and use it to make its decisions binding. Starting from this paradox, the author seeks, in the juridical, philosophical and literary discourses of modernity, the adequate tools to ensure a progressive differentiation of the law from vis, overcoming both the philosophical-juridical tradition that represents him as a Leviathan, as well as that which he wants him free from all forms of violence. In particular, through an unprecedented reading of the narratives of Kafka and Melville, he demonstrates how modern legal systems, even before being instruments of control, are dreams, fantasies of non-violence.
